Terms of Service

1. Who you are contracting with
The FixyourFilm platform ("Service") is provided by Fixyourfuture, established in the Netherlands ("we", "us"). By creating an account or otherwise using the Service you enter into a binding agreement with Fixyourfuture.
2. Acceptance
By continuing to access or use the Service you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Notice and Refund Policy. You must be of legal age in your jurisdiction and, if acting on behalf of an organisation, authorised to bind it.
3. The Service
FixyourFilm is a cinematic pre-production and rendering platform that uses AI providers to help you produce production bibles, images, audio and video. Output quality depends on your inputs and on third-party providers.
4. Acceptable use
You must not:
- use the Service for unlawful, infringing, defamatory or harmful purposes;
- generate CSAM, non-consensual intimate imagery, deceptive deepfakes of real people, or content that incites violence or hatred;
- attempt to reverse engineer, probe, scrape, overload or bypass technical controls;
- upload malware or content you do not have the rights to.
You are responsible for your prompts, uploads, and how you use the outputs, including verifying accuracy and clearing any third-party rights.
5. Intellectual property
We retain all rights in the Service, its software, models, branding and documentation. Subject to these Terms, you keep the rights you have in the inputs you provide, and to the extent permitted by the underlying providers you may use the generated outputs for your own creative and commercial projects.
6. Payments and credits — Paddle as Merchant of Record
Our order process is conducted by our online reseller Paddle.com Market Ltd. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries relating to payments and handles returns. Payment, billing, tax collection, subscription management and refund mechanics are governed by the Paddle Buyer Terms.
Credits purchased through Paddle are added to your account and are consumed as you use the Service. Refunds are handled according to our Refund Policy.
7. Service level and warranties
The Service is provided on an "as-is" and "as-available" basis. We do not warrant that it will be uninterrupted, error-free or that AI outputs will be accurate or fit for a particular purpose. To the fullest extent permitted by law we disclaim all implied warranties.
8. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claim relating to the Service is limited to the fees you paid us in the 6 months preceding the event giving rise to the claim. We are not liable for indirect, consequential or special damages (including loss of profit, data or goodwill). Nothing in these Terms excludes liability that cannot be excluded by law.
9. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly violate our acceptable-use rules. You may stop using the Service at any time.
10. Changes
We may update these Terms. Material changes will be announced in-app or by email and take effect on the date stated.
11. Governing law
These Terms are governed by the laws of the Netherlands. Disputes are subject to the exclusive jurisdiction of the competent Dutch courts, without prejudice to mandatory consumer protection rights in your country of residence.
